This presentation will cover the following topics:

  • Filing requirements: Many staffing firms register for payroll taxes when they have temps working in a state, but there can be other business tax filing requirements to consider. We’ll discuss state nexus considerations here.
  • Sourcing of revenues to states: Historically permanent placement were soured to the placement firm’s HQ, but with economic and market sourcing rules being prevalent now, these revenues are frequently sourced to the location where the employee is placed. Understanding these impacts can protect your business from exposure.
  • Sales taxes in temporary staffing: The sales taxability of temp staffing charges is often overlooked, as are the differing methods related to figuring out the tax base. We’ll talk through the issues connected to this area of the state tax world.
  • Local taxes – Another area of complexity that is often missed. We’ll cover what to look out for here.
  • Worker classification considerations – There can be a certain temptation to classify a worker as an independent contractor but significant thought should be given to the issue before doing so.

Eugene Ruvere is a partner in Citrin Cooperman’s White Plains office. Eugene’s central area of expertise is state and local tax. He has provided state income tax review services to both publicly and privately held companies to ascertain savings opportunities and exposures, as well as addressing client issues, from common to obscure, in regards to varied aspects of state and local tax, including income and franchise, sales and use, employment, and property taxes.

B.J. Hoffman is a tax partner with over 25 years of experience in the areas of audit, tax, and litigation support and leads Citrin Cooperman’s Staffing practice. As a tax specialist and CFE, B.J. counsels clients with a range of strategies, including detailed year-end multi-jurisdictional planning, which helps clients reduce income tax exposure. He also devotes a substantial amount of time to the area of trust and estate income taxation, as well as international taxation.
