Employers, including staffing firms, have an obligation to provide a healthy and safe work environment. On the one hand, the CDC and NYS have substantially relaxed workplace COVID-19 prevention measures. On the other hand, the New York HERO Act requires the implementation of workplace safety standards to protect workers from airborne infectious diseases (such as COVID-19). Join us as the panel addresses how staffing firms should tackle vaccination questions, and reconciles the relaxed CDC and NYS guidelines with the HERO Act. Among other questions, the panel will answer:

  • Can staffing firms and clients mandate COVID-19 vaccination and request proof of vaccination?
  • What happens if a candidate or employee refuses to get vaccinated?
  • Do staffing firms and clients have different responsibilities with respect to employees who are vaccinated and those who are not?
  • What obligations does the HERO Act impose?

  • Jason B. Klimpl, Partner, Tannenbaum Helpern Syracuse & Hirschtritt LLP & General Counsel, New York Staffing Association
  • Marisa B. Sandler, Associate, Tannenbaum Helpern Syracuse & Hirschtritt LLP
