Jason Klimpl, Partner at Tannenbaum Helpern and NYSA’s General Counsel, and Andrew Yacyshyn, Partner at Tannenbaum Helpern and NYSA’s Associate General Counsel, will give an overview of the recently promulgated Federal Trade Commission (FTC) non-compete rule and the Department of Labor (DOL) overtime rule, as well as notable New York State (NYS) employment updates resulting from the NYS Budget Bill. With respect to the FTC’s non-compete rule, Jason and Andrew will discuss, among other things, the rule’s prohibition on non-compete clauses, exceptions to the rule, and the legal challenges to the rule. Andrew and Jason will also discuss the DOL’s new overtime rule, particularly the new minimum salary thresholds that employees must be paid in order be exempt from federal overtime pay requirements. Finally, the team will address New York’s new paid prenatal personal leave requirements, paid lactation break requirements, and the sunsetting of NYS COVID-19 paid leave.
